Scope of application

Acceptance of the Conditions
By accepting the Terms or using the Site, you agree to be bound, without limitation or qualification, by the terms and conditions of the site. Access to and use of the Site are subject to full and unreserved compliance with these Terms.
If you do not wish to be bound by these Terms or if you do not accept them in full, you must refrain from accessing or using the Site.
By using the Site, without limiting the scope of what is otherwise provided in the Terms, you agree to (i) comply with all applicable laws in your jurisdiction of residence, (ii) provide us with accurate information and keep it current, and (iii) use the Site in a reasonable and responsible manner.
In addition, you agree not to:
use the Site for illegal or unlawful purposes;
infringe the intellectual property rights of SHEVA or others, including patents, trademarks, trade secrets, licenses, copyrights, or other proprietary rights;
monitor the availability, performance, or functionality of the Site for competitive purposes;
use any software, hardware, manual or automated coding robots or other means to access, decompose, analyze or index the functionality of the Site or any related services, data, or information;
transmit any code of a destructive nature that may damage, surreptitiously intercepts, expropriate or interfere adversely with any system, data, or personal information;
bypass any security features of the Site;
use the Site for any purpose for which it is not intended.
The Store and its original content, features, and functionality are and will remain the exclusive property of SHEVA and its licensors.
Links To Other Web Sites
Our Store may contain links to third-party web sites or services that are not owned or controlled by SHEVA.
SHEVA has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that SHEVA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We may terminate or suspend access to our Store immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Made to order
Depending on the degree of customization and the volume of orders we receive, the delivery time may vary. If customizable options are employed for a customer, each custom fixture requires at least a one week to be made to order.
Conditions of sale
The purchase of products including glass fixtures (the “Products”) through the SHEVA Inc. website (“SHEVA” or “we”) at (the “Site”) is governed by the terms and conditions appearing below. These terms and conditions constitute a contract of sale (the “Contract”) between SHEVA and you (hereinafter “you” or the “Customer”) as soon as you complete an order for Product(s) through the Site and you make payment of the sale price.
The sale price of a product is that indicated opposite this product on the Site at the time when your order is placed with SHEVA under. Unless otherwise stated, prices do not include applicable sales taxes.
Methods of payment
The payment of your purchase is made by credit card via the secure online payment. You agree to pay the full cost and expenses associated with the products purchased, including taxes, and handling, if applicable.
You are solely responsible for the actual payment of the product purchased. In the event that your payment cannot be validated or processed, your order will not be delivered and SHEVA will have no obligation to process your order.
SHEVA is not responsible for payment problems related to the operation of the secure online payment system.
How to order a Product
To order a Product, you will be asked to indicate the desired characteristics of the product among the options offered (model, length, diffuser design, aluminum finish, light temperature, and other customization options). You will then need to place the Product in your virtual shopping cart and proceed to the virtual checkout. You will then be asked to pay the sale price of the Product and applicable taxes.
In order to place your order definitively you must first accept the other conditions and press the “Submit my order” icon. CLICKING WITH YOUR CURSOR ON THIS ICON COMPLETES THE ORDERING PROCESS AND INDICATES THAT YOU AGREE TO PURCHASE THE PRODUCTS INDICATED IN THIS ORDER AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THE CONTRACT AND THOSE OF THE OTHER CONDITIONS.
Confirmation of your order
Confirmation of your order
You will receive a confirmation email a few minutes after placing your order. If it does not appear in your inbox, check your junk mail. A member of our Customer Service team will contact you by email 48 hours maximum after you have made a purchase to confirm your choice of options, the availability of materials and the time required to complete your light fixture
The receipt by email of your order confirmation does not automatically mean that SHEVA accepts it and is not a confirmation of commitment to sell the Products covered by your order. SHEVA reserves the right, in its sole discretion, to cancel or refuse any order for any reason whatsoever, such as:
the unavailability of a product at the time of processing the order;
certain inaccuracies or errors in the price or Product information;
problems in processing your payment;
the impossibility of delivering the Product to the delivery address indicated.
SHEVA may also require verification or additional information before accepting any order.
Products are shipped according to the option chosen when you placed your order and as confirmed on your invoice. SHEVA is not responsible for delays or clerical errors in the delivery address that are attributable to you or any other delay caused for reasons of force majeure.
Any damage to the Products delivered must be reported within 72 hours of receipt of said Product. To do so, please contact Customer Service. After 72 hours, the Product will be deemed to have been sent and received in perfect condition.
If you return a defective or damaged Product to SHEVA and the original packaging is not in good condition, suggesting that the defect or damage to the Product was caused upon delivery, SHEVA reserves the right to return the Product to you and retain the sale price.
By completing an order, you represent to SHEVA that you are of legal age to contract. Children under the age of sixteen (16) are strictly prohibited from purchasing Products through the Site.
By completing an order, you represent to SHEVA that you are purchasing Products through the Site solely for personal consumption and not for resale, distribution or marketing to third parties. You further represent that the personal information provided to SHEVA for billing purposes to complete the purchase is accurate. You also represent and warrant that you are the holder in good standing of the credit card with which you pay the sale price and applicable taxes for the products purchased.
The descriptions and illustrations of the Products offered or advertised on the Site are given for information purposes only. These may vary slightly from the Products actually offered, particularly as to what is indicated below. Consequently, you accept that such variations may occur and acknowledge that SHEVA cannot be held responsible for such variations.
The colors. The colors of the materials presented on the Site are calibrated according to established standards. Depending on your monitor calibration, colors may vary slightly.
Order accuracy and billing
You are responsible for ensuring the accuracy of the description of the Products ordered (model, length, diffuser design, aluminum finish, light temperature, and other customization options), the price and all billing details and, if applicable, correct any errors or inaccuracies. If any errors or inaccuracies cannot be corrected, you must promptly notify Customer Service by e-mail.
Once the order has been definitively completed, you will receive by e-mail a confirmation of your order accompanied by the invoice already paid and the Contract in digital format. You must print a copy of this email to ensure that you have the information mentioned in the purchase confirmation message and to double-check the terms and conditions of the Agreement that apply to you.
You have thirty (30) days from receipt of your invoice to have it corrected by SHEVA as long as you can prove that your invoice contains errors or inaccuracies. After this time, the information on your invoice will be deemed accurate.
Each provision of the Terms is individual and distinct and, should any of the Terms be held invalid, illegal or unenforceable, all other provisions of the Terms shall remain in full force and effect.
These Terms shall be governed and construed in accordance with the laws of the United States without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Store, and supersede and replace any prior agreements we might have between us regarding the Store.
The Site constitutes a dynamic and evolving environment subject to change. SHEVA may revise the Terms at its sole discretion by updating this page or the pages containing the provisions of the Terms to be modified. It is your responsibility to review the Terms on a regular basis to be aware of any changes that may be made to them.
If you do not agree with one or more changes to the Terms, then you must discontinue all use of the Site. Your continued use of the Site after SHEVA posts changes will constitute your acceptance of the changes to the Terms.
Return & Refund Policy
Return a Product
You can return all items purchased at SHEVA web-store for a full refund within 90 days of purchase.
To be eligible for a return, your item must be in the same condition that you received it, and in its original packaging. You’ll also need the receipt or proof of purchase.
To start a return, you can contact us at firstname.lastname@example.org. If your return is accepted, we’ll send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and issues
Please, inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. Any damage to the Products delivered must be reported within 72 hours of receipt of said Product. After 72 hours, the Product will be deemed to have been sent and received in perfect condition.

Exceptions / non-returnable items
In the certain cases certain types of items, such as personalized products or special orders are not returnable. Please do not hesitate to contact us if you have any questions or concerns regarding your item.
Unfortunately, we cannot accept returns of sale items or gift cards.
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method.
Return shipping costs
Return shipping costs will be paid by SHEVA for all cases where the product is incorrect or the product defects in materials or workmanship. For other cases (e.g. you changed your mind, you want an exchange), you will be responsible for this cost.
